A termination letter notifies an employee that he or she has been fired, lists the next steps they need to take and explains the benefits or compensation they are due to receive. Termination letters are also called a pink slip, letter of termination, contract termination letter, letter of separation, and notice of termination of employment.

Below you'll find a version of our employee termination letter template that you can copy and paste, and advice on how to write a letter to terminate an employee.

1. Basic termination letter to employee - without cause.

This employment termination letter is to inform you that your employment with The Internet Company will end as of October 29, 2017. This decision cannot be changed.

You will receive your final paycheck for this month and payment for remaining leave today. Once you have signed and returned the attached release of claims document, you will receive a $25,000 severance payment.

Your health care benefits will remain in effect for another 90 days.

You are requested to return the company laptop, swipe card, and cell phone before the end of the day.

Also, keep in mind that you have signed a confidentiality agreement. Please review the attached copy.

2. Sample Termination letter without Cause (staff reduction).

Oct. 1, 2020

Mr. Peters,

This letter of termination of employment is to inform you that your employment with Pied Piper, Inc. will end as of October 29, 2020. This decision is final and will not be modified.

You have been terminated for the following reasons:

Recent economic conditions have caused a significant downturn in sales, necessitating a 20 percent workforce reduction at Pied Piper. Unfortunately, your position is part of this reduction and has been eliminated.

You will receive your final paycheck after your last day, as well as payment for remaining leave. You will also receive a $15,000 severance payment provided the attached release of claims document is signed and returned.

Your health care benefits will remain in effect for 180 days after your termination takes effect.

You are requested to return the company vehicle, key card, and phone on your last day of employment.

Also, please keep in mind that you have signed a number of agreements which prohibit you from divulging confidential information. Please review the attached copies.

3. Sample Termination Letter for Cause (attendance).

Oct. 29, 2018

This separation letter is to inform you that your employment with Acme Internet Inc. will end as of October 29, 2018. This decision is not reversible.

We decided to terminate your employment for these reasons:

On September 29, 2018, you were absent from work without leave. At that time, you were given a formal written warning that your absence violated company policy.

On October 18, 2018, you were again absent from work, without leave. At that time you were given a second warning and informed that a third case within a year would result in your termination.

On October 28, 2018, you were absent from work without leave a third time, resulting in your termination.

Included with this letter of employment termination is your final paycheck.

Your health care benefits will remain in effect for 60 days.

You are requested to return any company property such as laptops, keys, and books before the end of the day.

4. Sample Letter of Termination of Employment due to Poor Performance.

Your employment was terminated for these performance reasons:

On July 1, 2019, you received performance coaching and were informed that your performance would be required to improve if your employment with Internet Industries Corp. were to continue. On August 25, 2019, you received a second warning and were informed that failure to improve performance within 60 days would result in your termination.

You have failed to meet the performance targets agreed upon. As a result, your employment has been terminated.

You will receive your final check for this month in the mail in 7 days. Once we have received a signed copy of the attached release of claims document, you will receive a $5,000 severance payment.

Your health care benefits will remain in effect for 35 days.

You are requested to return all company property, including your car, cell phone and ID badge before the end of the day.

Do you have to give an employee a termination letter?

There is no federal law that states that a company must issue a letter of termination, however, many employers do furnish them as a matter of principle. As most employees in the U.S. are at-will employees, the relationship between an employer and employee can end for any reason, or no reason at all, aside from a breach of contract or discrimination involving race, gender, ethnicity, etc.

How do I inform an employee about termination?

You can discuss the termination with the employee, but it is best to have a written notification.

What are the 5 fair reasons for dismissal?

  1. Misconduct.
  2. Performance or capability issues.
  3. Redundancy.
  4. Breach of a statutory restriction.
  5. Some other substantiated reason, such as expiry of a fixed-term contract, personality clash that severely affects the business or a significant conflict of interest.

What should be included in a termination letter?

  • The date the termination is effective from.
  • The reason(s) for termination.

Does an employee need to sign a termination letter?

No, not signing the termination letter does not affect the termination.

What is the minimum notice period for termination of employment?

Companies are not obliged to give notice to an employee before termination or layoff, unless the employee is under contract or covered by a union agreement. In that case, the employer-employee relationship is regulated by the terms of the contract.

Under the Worker Adjustment and Retraining Notification Act (WARN), employers with 100 or more employees are required to provide 60 days' notice in the case of a mass layoff or plant closure.

State and local laws may differ depending on your location, so be sure to contact your Department of Labor to find out more about local rules and regulations.

Typically this will be required in larger companies with big HR departments. They contain basic information about the termination, such as employee name, department, position, and date of termination.

When should I use a termination letter?

  • It is required by state or local law.
  • You believe the employee is ineligible for unemployment.
  • You want a record of the termination in case of a lawsuit.
  • The termination needs to be made clear to the employee.
  • You want to provide information on the employee's next steps.
  • You want to pass along information about owed compensation and benefits.

Is there a time when I should not use a termination of employment letter?

It's hard to imagine that situation. If you've got a letter of termination of an employee that just supplies the basic info, and sticks to facts, there's really no reason not to use it. Our termination letter example should be right in all situations. If there is any worry, leave off the reason for termination from the firing email template.

Is discharge the same as terminated?

The terms "discharge" and "terminated" are often used interchangeably, but the meaning changes as far as a contract is concerned. "Discharge of a contract" means that the main obligations of the contract have been met by the employee, signifying the end of the relationship between the employer and employee.

'We regret to inform you': The Epsilon breach letters you don't want to see

"We regret to inform you ..." are five words you never want to see in an email. But over the weekend thousands of people did as Epsilon began warning its customers that it had suffered a break-in and email addresses were stolen. Epsilon now says that about 50 of its client businesses were hit -- no small number as Epsilon blasts some 40 billion messages in their names each year.

The problem is that now security experts warn that a ton of spear-phishing attacks will be forthcoming. And then there might be more letters of regret.

So in case you didn't see one of these flaccid attempts to assuage customer nervousness, here are a few:

Target

Target's email service provider, Epsilon, recently informed us that their data system was exposed to unauthorized entry. As a result, your email address may have been accessed by an unauthorized party. Epsilon took immediate action to close the vulnerability and notified law enforcement.

While no personally identifiable information, such as names and credit card information, was involved, we felt it was important to let you know that your email may have been compromised. Target would never ask for personal or financial information through email.

Consider these tips to help protect your personal information online:

• Don't provide sensitive information through email. Regular email is not a secure method to transmit personal information.

• Don't provide sensitive information outside of a secure website. Legitimate companies will not attempt to collect personal information outside a secure website. If you are concerned, contact the organization represented in the email.

• Don't open emails from senders you don't know.

FORMAL LETTERS GIVING AND REQUESTING INFORMATION

Sample Letters of Intent to remove a trustee/ inform of a hearing or investigation

This resource provides letter templates on the following: letter of intent to recommend removal for cause,  letter of intent to recommend removal for cause, letter informing a member that they face an investigation, letter informing a member of a hearing,  letter of ‘no case to answer’ letter to remove a member who is unfit or unable to discharge the duties of a governor.

Letter of Intent to Recommend Removal for Cause

A Chair may recommend removal of a member from the roster for due cause based on a member’s failure to actively participate in committee proceedings or meet committee responsibilities, which include but are not limited to:

  1. missing two consecutive committee meetings without prior approval from the committee Chair,
  2. failure to attend at least 50% of scheduled committee meetings within any twelve month period,
  3. failure to return at least 60% of the letter ballots within any twelve month period, and/or
  4. failure to fully disclose a conflict of interest.

Prior to submitting a recommendation for removal, the Chair shall notify the committee member in writing of his/her intent to recommend removal for cause and the reasons why (see example letter of intent below).  An offer to the member to resign from the committee rather than be removed for cause is highly recommended.  

The recommendation for removal is submitted via the Chair’s Membership Recommendation Form. The Chair shall complete the Removal of Member section of the Chair’s Membership Recommendation Form, and include documentation of the committee Chair’s communication to the member, his/her response, and written justification for the recommendation (e.g., copy of meeting minutes noting absences, letter ballot vote counts noting unreturned ballots, etc.).  The recommendation will be acted on by.

Sample Letter of Intent to Recommend Removal for Cause:

Dear _______,

I am writing to you because of your recent lack of participation in meetings and e-mail ballots of  XX. You have missed XX meetings and have not responded to XX e-mail ballots in the last XX months. {Since it has been possible to attend these meetings electronically this is an unacceptable level of participation.} We are having trouble achieving a quorum because of your lack of participation.

You have several options for how to proceed. These are:

  1. Resign – this can be done with a simple email message to me with a copy to the Manager of Standards.
  2. Respond and make a case for why you have been absent and how you will be able to actively participate in the future.
  3. Become a non-voting member – you can opt to have your voting status changed to [NVM or PSVM] by responding immediately.  You will also need to submit required documentation for a change of status without delay when contacted by staff.

If you don’t do any of these things by [date – generally 2 weeks] I will request that [appropriate staff] act at its next meeting to remove you from the roster for lack of participation.

Leaving the committee does not mean that you are unable to participate further. You can join any meeting as a guest and you can participate in the public reviews of the draft standard. I would strongly encourage you to do these things. I appreciate your past service but I think you can understand that in order for the committee to function I must act to remove inactive members. I look forward to learning of your decision.

SAMPLE LETTER INFORMING A MEMBER THAT THEY FACE AN INVESTIGATION

Private and Confidential

This is to confirm what was said at our meeting on (date of meeting).  The meeting took place in (room); (name) was present as your (colleague/support).

You face the possibility of being removed as a Member of the Corporation Board on account of (brief description of the matters of concern).  This/these matters will now be investigated further.  It is anticipated that the investigation will be completed within (timescale).  If there is some good reason for it not to be complete within that timescale I will write to you again with an explanation.

At the end of the investigation the outcome could be that there is no case to answer and in those circumstances I will inform you in writing at the earliest opportunity.  Otherwise you will be informed of the need for you to attend a hearing at which you will have the opportunity to respond.  You will be given 10 days notice of this, which you can choose to reduce if you so wish.

Please treat this matter as confidential, it is not appropriate that it should be discussed at anything other than a formal meeting called for that specific purpose

It is requested that you do not attend Corporation Board meetings or conduct other Governance business whilst this process is ongoing.  This is not meant to infer that there has been any judgement made (explanation given here of circumstances of request not to attend meetings etc).

SAMPLE LETTER INFORMING A MEMBER OF A HEARING

Private and Confidential

Further to our meeting on (date when member was informed that they may face a hearing) I am now writing to inform you that a hearing is to be held.

This is scheduled to take place at (time) on (date) in (room).  You should report to (room) where you should wait until invited into the hearing.

If this date is not convenient for you then you should contact (name) immediately to arrange an alternative.  Please note that the time delay is to give you an opportunity to prepare; the hearing can be held sooner by mutual agreement.

If you fail to attend without good reason the meeting will go ahead in your absence.  If you seek to delay the meeting you can do so but only by up to a further 5 working days.

The hearing is being called to consider (specific nature of the concern).  The meeting will be chaired by (name).  Copies of all documents that will be considered at the hearing are enclosed.  Any documents that you intend to refer to should be forwarded immediately, addressed to me.

You have a right to be accompanied.  This should ideally be by a fellow Governor, but not a member of the Search Committee nor a legal or professional adviser unless the College agrees otherwise having received such a request in advance or if the College intends to be legally represented itself.  Members of the staff welfare team are available on request to support and accompany you.

It is the Colleges policy that if you choose not to be accompanied, then a member of the staff welfare team will be asked to attend the hearing as an independent observer.  I would therefore appreciate it if you would confirm that you will make your own arrangements to be accompanied and the name of the person accompanying you.

Please remember that this matter is confidential; it is not appropriate that it should be discussed at anything other than a formal meeting called for that specific purpose.

SAMPLE ‘NO CASE TO ANSWER’ LETTER

I am writing to inform you of the outcome of the investigation/hearing.

It has been determined that there is no case for you to answer.  This is because (brief explanation).

This means that the matter is now formally closed.

SAMPLE LETTER TO REMOVE A MEMBER WHO IS UNFIT OR UNABLE TO DISCHARGE THE DUTIES OF A GOVERNOR
