i Guys,
i need some help,
i joind a company back in 2004 and then 4 months later i left, and due to some family problems, i told my employer i could not come. He then told me if i were to leave i would have to send my passport so he could cancel my visa otherwise he would have to report me missing and then i would be ban from dubai for 2 years, is that ture, and then what happens after 2 years can i re-apply for another job without any problems or worries of a life ban or anything else.

Is there any fees to lift the automatic ban.If he has completed
2 years of service,NOC from current employer nor available.
less than one year of service but NOC not available.
I have seen in MOL website that a fee called one year ban lifting fees is vailable,whether this is applicable to employees without NOC.

thanx jatinvk, no i dont have a labour card no. and i didn't send my passport. Do you work in the immigration department in dubai, i have a friend who is getting me the details about my previous visa. that is if i have a ban or no.
do you have a dubai contact no. i could call you on, that is if you can help me.
BTW i have gone to dubuai in 2004 and then left in the last month of that year and my visa was valid till i think october 2007 i justed wanted to know based on my situation what ban will be applied to me and when does that ban exactly take affect as soon as the visa gets over in 2007 or as soon as i leave the country or as soon as the employer infoms me as missing.

about the ban & threatning from the sponsors mostly depends upon your labour contract signed initially for processing your labour card.. see most of the stuff avl online in their websites & outdated & vague. you can post me incase u cannot find a way out. would be glad to help u'll out.

Hi, i too work in uae, i think you must have sent your pp to your employer(if you trust) so that the visa can be cancelled,your employer was correct and he made you aware that he might file absconding, in that case you can not come to dxb in any case,i dont know how jatin missed this as a pro if you are out of dxb for more than 6 months u r visa will be invalid,i think it is too late now and your employer must have filed abs,better contact u r company and check the status,they will clear you this is of my knowledge,some times we do like this we will get the pp and cancel the visa when the pp holder is in india.

Dear sam,
Nice to hear from you, but to ask you one question .. how can u report a employee absconding if he's outside country ??? which means you have authourized him a leave & that person has not come back.... my dear absconding means " the employee is working with some other sponsor under your visa, without your knowledge" which is illegal according to labour law...
well you are correct that the residence visa will be invalid if a person resides outside U.A.E for more than six months... but in that case the sponsor can only cancel their visa & not report absconding...

According to our company we are filing abs to the workers who are granted leave for 1 month and the person is not reporting to work,we will wait for 10-15 days then we will file abs even he is in india or any other country b coz we are in immigratio ctrl,can you plz give your mobile no so that i can call you when you are free.

1.) Do an employer have rights to terminate its employee b4 the probation period, if yes what shud be the situtation in that case.

first of all welcome to this fourm,
you first question was about termination under probation period. Well termination under probation period is not such formal as in after confirmation. the reason provided can be unsatisfactory perfomance.
The ban point can only be defined after knowing the current visa status if valid or the cancellation receipt of labour card & residence visa.

Dear Jatinvk / Pro,

Finally I have found a group that would be able to help me on my UAE visa concerns.

I left UAE last July 2008 for a vacation. After a month, I have submitted my resignation letter to my employer. He didn't accept it and he told me to think about it and he is giving me 6 months extension.

Last January 2009, I informed him that I will not be able to come back and my resignation remains.

I have joined a company in the Philippines. My passport has expired and I have a new one. In February 2009, I had to visit Dubai for a business trip. My company applied for a visit visa but I was refused because my residence visa is still active.

I need to pursue my Dubai business trip this April. I was wondering how come my residence visa was still active inspite that I was out of UAE for 6 months. Is it because my employer has extended me? If so, when should I expect that my residence visa be cancelled authomatically?

I will really appreciate your thoughts on this matter. I have been anxious for the last few days as I am pressured to go to Dubai for my business trip.

I used to work for one of esteemed construction firm in dubai from june-2007 but due to some personal reasons I came back to India on emergency leave in nov-2007 and went back to Dubai in jan-2008......n again in july-2008 i came on my annaual vacation but due to my personal problems i could not go back to dubai n even my visa was not cancelled.......can u lemme know when can i enter uae on employment visa from other company.

I am cusrrently working in oman and serving my notice period to join company in dubai, however my omani emloyer is insisting me not cancel visa now and do it after two months, I need to know whether uae immigration allow me to enter in dubai with having employment visa on my passport? myself sachin shirsath i had come to uae in 2003 and joined a co. named al isikander at jebel ali free zone it was a jewellery mfg.co.
there i faced a problem of severe back ache for which i had to come back to india for treatment in jan-2004 with the owners permission but after coming here i didnt go back as it was late i.e. more than 6 mnths. but when i was ok i called back to the co. thet i wanna b back they said its not possible now, u search for some other co.after that i applied for visa in 2006 but it was rejected saying that i m absconding so i called the co. they said it is only for 6 mnths but the ban was still there after 6 mnths also.and now recently also my visa was rejected in feb 2014saying i am absconding plz help me and advise me what to do?

Iam Deepu. I was working in dubai before 3 years....in security services....
i worked for 1 year and 2 months... my father died and i gone to india...
i couldn't rejoin due to family problems...
i read from sites that there would a 1 year ban or a life time ban...
if its a 1 year ban then its probably finished...
but if its a lifetime ban what should i do ???
how can i know that ??? i have applied for another visa for an oil company in abudhabi....
my old passport is lost and its my new one now....so will the visa will be generated and on arrival after a retina scan will i be identified as an absconder ??
and deported or punished ?? its my doubt...
without cancelling the older visa can i go to uae in new visa ?? will i be deported ??

Hii Jatin. . I had got a job In Sharjah, UAE where i have worked for 20days in my visit visa. But then i had to EXIT from UAE as my Visa was about to expire. . the company were i have worked had said that they will provide me a Residence Visa. . But after i came to INDIA i got a good offer from Saudi Arabia. . i said the same with my sharjah employer so he said my visa is ready n he's demanding i need to pay 10000dhs to him otherwise he vl put up a Passport n Immigration GCC Ban. .
I want to Know whether he can put up a GCC Ban for me?? when i haven't yet visited UAE on the company Visa.??
Someone Please help me on this.

Nice to hear from both of u mine is also the same case i came to india with the consent of the company as i was not well & the reason to come to india was also my bad health,but i couldnt go back so they reported me as absconding its been 10 years now i came back in 2004 still till last year the ban is there and the employer is not ready to talk my visa was of jebel ali free zone how can i lift the ban if the employer is not ready to help?

The language to be used in a cancellation letter can be baffling for some of us. This article will help you draft a perfect cancellation letter that follows the formal letter writing etiquette.
Cancellation letters are usually written for canceling certain services or orders. These letters have to be specific with respect to what one has to say. The cancellation details need to be expressed very concisely and clearly, in order to reduce chances of a misunderstanding. Here are a few tips on writing cancellation letters.
  • Length: 1 page
  • Word Count: 150 to 300 words
  • What to Avoid: Lengthy description
  • While writing cancellation letters, the language used must sound polite but firm.
  • It is important to include date, name of the company, your name, contact details, your account number/client identification number, etc in your letter.
  • While writing, clearly mention that the company no longer has an authority to continue any kind of activity with your account/client id.
  • State in the letter that you wish to receive a written confirmation about the cancellation.
  • You need to keep in mind that there is a notice period of 30 days before a cancellation is made effective. Specify the steps you will take in case your account is not canceled within the stipulated 30 days' time.
  • Type the letter, print it on a good-quality paper and include your signature as well.

Effective 1 March 2019, the Department of Labor and Employment (DOLE) has issued new guidelines for applications for cancellation of Alien Employment permits (AEPs).

What has changed?

According to the new instructions, the original AEP card must be submitted with the cancellation request. Previously, it was sometimes possible to attach only a copy.

Moreover, in addition to a letter requesting cancellation and the valid ID of the company representative or liaison officer, the application must now include a letter from the company or employee authorising the representative or liaison officer, and a document including the location or a map of the company.

Background

An employer wishing to terminate the employment of a foreign national holding a valid 9(g) work visa (e.g., at the expiry of the employment contract) is required to downgrade their visa (and any dependent visas) to a 9(a) temporary visitor visa, cancel their ACR I-Card, obtain an Emigration Clearance Certificate (ECC) and cancel their Alien Employment Permit (AEP) with the Department of Labor and Employment (DOLE).
